Terms of service

Note: These Terms of Service apply to consumer purchases (B2C) only. For business, trade, or hospitality orders (B2B), separate terms apply.
Definitions
- Agreement: any agreement under which we commit to deliver the Products to you subject to these Terms of Service.
- Consumer: a consumer as defined in Article I.1,2° of the Belgian Code of Economic Law, being a natural person acting for purposes outside their trade, business, craft or profession.
- Party/Parties: you and/or us.
- Product: all goods offered for sale on our Website.
- Terms of Service: these terms and conditions applicable to the relationship between you and us when purchasing Products.
- We/Us/Our: the company identified in “Our Identification.”

- You/Your: a Consumer acting as a customer.

Applicability
These Terms of Service apply to all B2C purchases of our Products. By placing an order, you explicitly accept and agree to them. Nothing in these Terms affects your statutory consumer rights under Belgian law.
We may amend these Terms from time to time. The version in force when you place your order governs your Agreement with us.
Offer and Acceptance
- We strive to present product information and images as accurately as possible. Minor, non-essential differences between delivered Products and website descriptions/photos do not constitute non-conformity.
- Availability is not guaranteed and offers are valid while stocks last. If a Product is unavailable, we will notify you by email and you may cancel your order.
- We are not bound by obvious mistakes or errors in pricing or product details and may correct such errors even after the Agreement is concluded.
- Your acceptance occurs when you place an order on our Website. After payment, you will receive an order confirmation by email.
- You are responsible for the accuracy of the information you provide and should inform us of any errors without delay.
- We may refuse an order in the event of a serious shortcoming on your part.
- Parties acknowledge that electronic communication constitutes a valid Agreement. Electronic files may serve as evidence; no special signature is required.
Prices
Prices shown on our Website apply at the time of order. Prices refer only to the Products as described and exclude decorative elements shown in photos. All prices are in EURO and include VAT and applicable taxes. Any additional costs are shown separately.
We may adjust prices at any time, but the price at order placement applies. Changes due to VAT rate adjustments will be passed on.
Payment
- Full payment is due when you place the order. Accepted methods: iDEAL (NL), Bancontact (BE), Maestro, Visa/Mastercard, Apple Pay.
- Payments are processed securely through authorized partners.
- We use Shopify’s external payment platform; payments are subject to Shopify’s terms.
- We may suspend delivery until full payment is received. Ownership remains with us until payment is completed.
Delivery
We process orders promptly and ship only to the countries listed below. Indicative delivery times:
- Austria: 2–4 working days
- Belgium: 1–3 working days
- Bulgaria: 5–7 working days
- Croatia: 3–5 working days
- Czechia: 3–5 working days
- Denmark: 2–4 working days
- Estonia: 3–5 working days
- Finland: 4–6 working days
- France: 2–4 working days
- Germany: 2–4 working days
- Greece: 9-11 working days
- Hungary: 4–6 working days
- Ireland: 4–6 working days
- Italy: 3–5 working days
- Latvia: 3–5 working days
- Lithuania: 3–5 working days
- Luxembourg: 1–3 working days

You must ensure delivery can take place at the address provided by you or a designated recipient. Delivery is completed when the Products are physically received. We mainly use DPD and Bpost. If a shipment is missing, we will open an investigation with the carrier. This does not affect your statutory right to withdraw from the contract.
If delivery is not possible within 30 calendar days, you may set an additional reasonable period. If we still fail to deliver, you may terminate the Agreement and we will refund you within 14 days. Exceeding delivery times does not entitle you to other compensation.
Ownership remains with us until full payment. Risk transfers upon physical receipt. Intellectual property rights remain with us or our licensors.
Right of Withdrawal
You have the right to withdraw from your purchase within thirty (30) days from the day after delivery, without giving reasons. If multiple Products are delivered separately, the period starts upon receipt of the last item.
To exercise your right, notify us at info@qoozii.com before the withdrawal period expires.
Refunds: We refund the purchase price and any standard delivery costs paid (express or supplementary delivery charges are not refunded). Refunds are made within 14 days of your withdrawal notice, and may be withheld until we receive the Products or you provide proof of return.
Returns: Return shipping costs are borne by you. You may use our €10 prepaid label (deducted from your refund) or arrange your own return. Products must be unused and in re-sellable condition with all protective materials, labels, and original packaging. We may deduct for any loss of value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
Exclusions: No withdrawal right for personalised/customised goods; perishable goods; or sealed goods not suitable for return for health or hygiene reasons once unsealed.
If a parcel is automatically returned due to an incorrect address or failure to collect, it is processed as a return. We refund the Products less €10. To receive the Products, please place a new order with correct details.
Warranty
QOOZII lamps are covered by the EU legal guarantee of conformity for two (2) years. Rechargeable batteries include a one (1) year commercial warranty, which is in addition to your statutory rights. The warranty does not cover normal wear and tear, accidental damage, or misuse contrary to the instructions.
To claim warranty, notify us within two (2) months of discovering the defect at info@qoozii.com and provide the necessary details (photos if relevant). The warranty covers repair or replacement. If these are impossible or disproportionate, we may offer a price reduction or refund upon return of the Product.

Liability
To the extent permitted by law, we are not liable for indirect or consequential damages. Nothing in these Terms excludes your statutory consumer rights or our liability for intent, gross negligence, death, personal injury, or fraud. If we are held liable, compensation is limited to the total amount paid for the Products concerned.
Data Protection
Your personal data is necessary to process and fulfil your orders and for accounting. Providing false or incorrect data is a breach of these Terms. Personal data is processed in accordance with our Privacy Policy.
Intellectual Property
All intellectual property rights in our Products and in the Website content (texts, graphics, photos, images, audio, video, software) remain with us or our licensors. You may not copy, reproduce, publish, or otherwise use such content without our prior written consent.
Force Majeure
We are not responsible for failure to perform obligations due to force majeure (circumstances beyond our reasonable control). Obligations are suspended during such events. If force majeure lasts more than two (2) months, either Party may terminate the Agreement by written notice, with refund of undelivered Products.
General Provisions
If any provision of these Terms is invalid or unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision shall not be deemed a waiver. These Terms constitute the entire agreement between the Parties. Deviations are valid only if agreed in writing.
Governing Law and Jurisdiction
These Terms are governed by Belgian law, excluding the Vienna Sales Convention (CISG). You may also submit disputes via the EU Online Dispute Resolution platform.
Disputes fall under the courts of our registered office, unless another court is mandatorily prescribed by consumer protection law.
